Firearm and self-defense related bills

HB 2068 (Dead - Failed to move before Adjournment)
Weiers JP - private enterprise; game; fish; fund

Creates the Youth and Women’s Shooting Sports Fund (Fund) and allows the Arizona Game and Fish Commission (Commission) to sell goods and services.

AzCDL supports this bill.


HB 2222 (Dead - Failed to move before deadline)
McClure - misconduct involving weapons; real property

Clarifies the right to carry a concealed weapon, without needing a concealed weapons permit, on property or in vehicles that is owned, leased or rented, along with common areas.

This bill also contains a rewrite of ARS 13-3102.F that clarifies that if any portion of a weapon or holster is visible the weapon is openly carried.

Allows for lifetime complimentary hunting licenses for hunters 65 and older.

Alvarez - firearms; school grounds; penalty

Increases the penalty for possession of a firearm on school grounds to a Class 5 Felony.

AzCDL strongly opposes this bill.

Weiers, JP - firearms; airport designated secure area

Adds “airport designated secure area” to ARS 13-3102 (misconduct involving weapons).

AzCDL opposes this bill.

Kavanagh - misconduct involving weapons; means; transportation

Removes the reference to vehicles in ARS 13-3102 (misconduct involving weapons), eliminating the ambiguity about where a weapon can be carried in a vehicle, without a concealed weapons permit, resulting from State v. Adams.

AzCDL requested this legislation and strongly supports it.


HB 2429 (Dead - Failed to move before deadline)
Gallardo - misconduct involving weapons; polling places

Establishes a new 75 foot perimeter around polling places where weapons are prohibited. Current law prohibits weapons inside polling places.

AzCDL strongly opposes this bill.


HB 2430 & HB 2431 (Dead - Failed to move before deadline)
Gallardo - prohibited possessors; gun storage & loaded firearms; storage

These companion bills make you a criminal and lifetime prohibited possessor, along with being subject to personal liability, if a minor gains access to one of your firearms and causes injury or death.

Virtually identical bills have been introduced for the last two legislative sessions.

AzCDL strongly opposes these bills.

Burns J - Arizona rangers; limited authority status

Allows Arizona rangers to possess firearms on school grounds under certain limited circumstances.

AzCDL is neutral on this bill.

Burns J - weapons; misconduct; application

Adds Community Correctional Officer and Special Investigator to the list of law enforcement positions exempt from most weapons misconduct violations.

AzCDL opposes this bill.


HB 2486 (Signed by Governor 3/21/08)
Weiers J - prohibited possessors; undocumented aliens

Adds undocumented aliens to the list of prohibited possessors.

AzCDL is neutral on this bill.


HB 2536 (Dead - Failed to move before deadline)
Paton - firearms; vehicles; employee parking areas

A public or private employer cannot prohibit a person from transporting or storing a firearm in a locked vehicle in a parking area, (subject to certain exceptions).

AzCDL requested this legislation and strongly supports it.


HB 2574 (Signed by the Governor 4/28/08)
Weiers JP - airports; designated security areas; weapons

Makes carrying a weapon in an airport security area a Class 1 Misdemeanor.

AzCDL is neutral on this bill.


HB 2626
Pearce - weapons; peace officers; posse; reserves

Allows a sherif to authorize posse volunteers and reserve officers with firearms training to carry a deadly weapon without a CCW permit. It also excludes individuals who have completed peace officer training from the CCW permit training requirements.

AzCDL is neutral on the overall bill, but supports the provision that clarifies Arizona’s “open carry” statute.

Pearce - carrying firearms; exceptions

Primarily deals with undocumented aliens as prohibited possessors, but contains many provisions beneficial to CCW permit holders.

AzCDL supports this bill.

Pearce - justification; defensive display of firearm

Clarifies when a defensive display of a firearm is justified.

AzCDL requested this legislation and strongly supports it.


HB 2630 (Vetoed by Governor 4/26/08)
Pearce - concealed weapons; petty offense

Reduces the penalty for carrying a concealed weapon without a permit to a petty offense, except in the commission of a crime.

AzCDL requested this legislation and strongly supports it.


HB 2634 (Signed by Governor 6/12//08)
Murphy - concealed weapons permit; felony convictions

Clarifies that a person with an expunged felony, or who has had their rights restored, may obtain a concealed weapons permit.

AzCDL requested this legislation and strongly supports it.

McClure - landlord tenant acts; constitutional rights

Prohibits rental agreements from requiring tenants to “waive or forego the peaceful exercise of rights guaranteed under Article II, Constitution of Arizona.”

Gallardo - firearms; prohibition; post-secondary institutions

Adds “post secondary” institutions (i.e., colleges and universities) to places where weapons are prohibited.

AzCDL strongly opposes this bill.

McGuire - misconduct involving weapons; vehicles

Adds “closed purse” to the places a weapon can be carried in a vehicle without a CCW permit.

AzCDL supports this bill.


HB 2833 (Dead - Failed to move before deadline)
Garcia, M - coded ammunition; state database

Requires ammunition manufacturers to encode an individualized serial number on each bullet base and cartridge case. Possession of non-coded ammunition would be illegal.  All ammunition sales would be recorded. A 1/2 cent tax would be added to every round of ammo sold. Manufacturers and vendors would face stiff fines for not-complying.

This bill would effectively end ammunition sales in Arizona.

HCR 2037 (Failed in House 3/24/08)
Weiers JP - constitutional rights; game and fish

Adds a right to hunt and fish to the Arizona Constitution.

AzCDL strongly supports this bill.


SB 1070 (Signed by Governor 6/10/08)
Gray, C - concealed weapons permit; qualifications; instructors

  • Clarifies that with adequate documentation a person can renew an expired permit, or obtain a new permit if training occurred within the last 5 years.
  • Allows that training can be conducted by NRA instructors.

AzCDL requested this legislation and strongly supports it.


SB 1106 (Vetoed by the Governor 5/28/08)
Gray C - concealed weapons permit; renewal option

Provides for an optional lifetime concealed weapons permit and caps permit fees.

AzCDL strongly supports this bill.


SB 1132 (Dead - Failed to move before Adjournment)
Harper - firearms; restaurants; posting

Firearms are permitted in certain restaurants provided signs are posted permitting firearms, and the person possessing the firearm does not consume alcohol.

This bill needs work and we will attempt to work with the sponsor to secure needed amendments during the legislative process.

Unless positive changes are made, AzCDL is neutral on this bill.


SB 1161 (Dead - Failed to move before deadline)
Gray C - concealed weapons permit; fee

Caps the CCW permit renewal feel at $65.

AzCDL strongly supports this bill.


SB 1214 (Dead - Failed to move out of Senate before deadline)
Johnson - concealed weapons; school grounds

Proposes changes to ARS 13-3102 to allow adults with Concealed Weapon (CCW) permits to carry concealed firearms on school campuses, including colleges and universities. Federal law (18 USC § 922(q)(2)(B)(ii)) already allows CCW permit holders to possess firearms on school property.

AzCDL requested this legislation and strongly supports this bill.

Johnson - gun-free zones; liability

 If any government entity establishes a “gun-free” zone, they are liable for damages resulting from criminal conduct if an individual could have used a firearm in self-defense.

Increases the penalty for “harassing” a minor to a Class 5 Felony while broadly expanding the definition of harassment.

Prohibits cell phone use by a minor, while driving, unless a “hands free” method is used.

Robson - internet service providers; records

Requires internet service providers to keep records on customers and provide that information to Federal and State agencies upon request.

Mason - photo enforcement; driving record; insurance

Prohibits the Motor Vehicle Division (MVD) from assessing points to driver licenses for photo enforcement related citations. In addition the bill would prevent insurers from using that information when determining insurance rates and insurability.

HB 2660 (Failed in Senate Judiciary Committee 4/8/08)
Nichols - joint; several liability; criminal offenses

Would make it a crime to publish, broadcast, produce, etc. any material that would incite anybody to "commit terrorism or a felony act".

Registered vehicle owner is responsible for “photo enforcement” ticket.

Burges - REAL ID act; implementation prohibited

Prohibits the implementation of the REAL ID Act in Arizona.

Tobin - distracted driving

Creates a nonmoving civil traffic violation for “distracted driving” as a secondary offense. Distracted driving would include things like cellphone use, reading, eating, drinking, personal grooming, etc.

Abelser - eminent domain; slum clearance; repeal

Repeals portions of the Private Property Rights Protection Act of 2006.

Gould - requirement on highways; photo radar

Puts the issue of photo enforcement systems on state highways to detect violators of speed restrictions on the ballot for voter approval.

AzCDL supports this bill.


SCR 1033 (Dead - Failed to move before deadline)
Gould - speeding citations; photo enforcement systems

Subject to voter approval, statutorily limits the issuance of photo enforcement system citations to speed violations for vehicles traveling faster than 85 percent of the vehicles on the highway and specifies how to determine the minimum speed limit that will result in a citation.
