Harper - homeland security force

SB 1132 is legislation that would accomplish the same essential purpose as SCR 1006 without going to the ballot. The proposal would create the Homeland Security Force (HSF) and the Homeland Security Committee, along with rules and procedures to govern the HSF.  It appropriates $10,000 from the state General Fund in FY 2007-2008 to the Governor for administration of the HSF. The committee would direct and regulate a “homeland security force” consisting of citizen volunteers that are subject to training and not subject to federal active duty.

AzCDL strongly supports this bill.

Gray L - (As originally filed) jury duty exemption; cognitive disability
(NOW: applicability; self-defense)

SB 1166 was amended on 4/4/07 in the House Appropriations committee. The original language was replaced with the language from SB 1302 (Castle Doctrine/Burden of Proof) modified to address the governor’s concerns in her veto letter.

AzCDL strongly supports the amended version of this bill.

Gray C - concealed weapons permit; renewal

Deletes the requirement to obtain fingerprints upon the first renewal of a CCW permit.

Gray C - deadly weapons; storage

Makes various changes to ARS 13-3102.01 (storage of deadly weapons in public buildings/events). Defines “secure storage” and “readily accessible” and states that an operator may not record the identity of the person or serial number of the weapon, except temporarily for purposes of identifying the owner of the weapon upon its return.

Prohibits the Governor or Adjutant General from confiscating lawfully held firearms or ammunition during a state of emergency.

Johnson - misconduct involving weapons; exception

Rewrites 13-3102.F to clarify that if any portion of a weapon or holster is visible, the weapon is openly carried.

Johnson - Misconduct involving weapons; classification

Reduces carrying a concealed weapon without a permit to a petty offense, from a Class 1 misdemeanor, unless committed in conjunction with a felony or a serious or violent crime.

Allows people to let their grandchildren use their big game permits and tags to take big game under certain limited circumstances.

Pearce - firearms; peace officers

Exempts all AZPOST certified peace officers from any rule in any political subdivision of AZ forbidding them from carrying a firearm, with specific listed exceptions. Amendments have added exemptions from civil liability that may or may not work out well.

Pearce - concealed weapons; petty offense

Would change the penalty for not carrying your CCW permit with you to a petty offense (from the current Class 2 Misdemeanor).

Johnson - private schools; technical correction

Senator Johnson’s “Strike Everything” amendment that completely replaces the subject and text of the original bill passed in the Senate Government committee. SB 1152 is now a bill that prohibits the implementation of the REAL ID act of 2005 in Arizona:

“This state shall not participate in the implementation of the REAL ID act of 2005.  The department shall not implement the REAL ID act of 2005 and shall report to the governor and the legislature any attempt by agencies or agents of the United States Department of Homeland Security to secure the implementation of the REAL ID act of 2005 through the operations of that department.”

AzCDL strongly supports this bill as amended.
